"The 14th Amendment to the Constitution prohibits states from discriminating on the basis of race. It says: Nor shall any state "deny to any person within its jurisdiction the equal protection of the laws." That amendment grew out of the Republicans' first big dust-up with the Democrats over race – the Civil War. Then, as now, Democrats demanded the right to discriminate on the basis of race. The 14th Amendment sternly informed Democrats that they would have to stop.
